Terms of Service

1. Agreement
These Terms of Service ("Terms") govern access to and use of ICON Field Service Management ("ICON FSM," the "Service"), a software-as-a-service platform provided by ICON Imagineering, LLC ("ICON," "we," "us," or "our"), available at iconimagineering.com and related application hosts. By creating an account, completing onboarding, or using the Service, you agree to these Terms on behalf of yourself and the business you represent.
2. What we sell
ICON FSM is business software for HVAC and mechanical repair companies. It includes tools for scheduling, dispatch, field technician workflows, estimates, invoicing, memberships, customer tracking, optional AI voice receptionist features, and related administrative functions. We do not sell homeowner repair services through this website; those services, if any, are provided by independent HVAC businesses that subscribe to the platform.
3. Accounts & eligibility
You must be at least 18 years old and able to form a binding contract. You are responsible for safeguarding login credentials and for activity under your company account. You must provide accurate business information for billing and verification.
4. License
Subject to these Terms and timely payment of subscription fees, ICON grants you a limited, non-exclusive, non-transferable, revocable license to access and use ICON FSM for your internal business operations. You may not reverse engineer, resell, sublicense, or use the Service to build a competing product, except to the extent such restriction is prohibited by applicable law.
5. Subscriptions & billing
Platform fees are billed on a recurring basis (typically monthly) via Stripe according to the plan you select (e.g., Starter, Growth, Pro) and any add-ons (e.g., AI Voice). Prices are listed on our Pricing page and may change with notice for subsequent renewal periods. Failure to pay may result in suspension or lockout of paid features until the account is brought current. Customer payments collected through Stripe Connect for your end customers are separate from your ICON SaaS subscription; those funds are yours subject to Stripe's terms and your agreement with your customers.
6. Cancellation
You may cancel your subscription at any time as described in our Refund & Cancellation Policy. Cancellation stops future charges at the end of the then-current billing period unless otherwise stated at checkout.
7. Acceptable use
You agree not to misuse the Service, including by: violating law; sending spam or abusive communications via voice/SMS/email features; attempting unauthorized access; uploading malware; infringing others' rights; or using AI/voice features for fraud or deceptive practices. We may suspend access for material violations.
8. Customer data
You retain ownership of data you submit about your business, jobs, and customers ("Customer Data"). You grant ICON a limited license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for having a lawful basis to process your end customers' information. Our handling of personal data is described in the Privacy Policy.
9. Third-party services
The Service integrates with third parties such as Stripe, Supabase, Twilio, Mapbox, Resend, and AI model providers. Your use of those services may be subject to their terms. ICON is not responsible for outages or acts of third-party providers beyond our reasonable control.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-generated outputs (including voice transcripts and suggestions) may be inaccurate and require human review.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICON IMAGINEERING, LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO ICON FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnity
You will indemnify and hold harmless ICON from claims arising out of your Customer Data, your use of the Service, your communications with end customers, or your violation of these Terms or applicable law.
13. Changes
We may update these Terms by posting a revised version on this page with an updated effective date. Continued use after the effective date constitutes acceptance of the revised Terms.
